Terms and Conditions

1. The Promoter

Lucky Aura Competitions Limited (company number: 16300173) of Riverside Business Park 3 Connaught House, Benarth Road, Conwy, United Kingdom, LL32 8UB is the promotor (Promotor) and responsible for the competition website https://luckyauracompetitions.co.uk/ (Website) and the running and administration of each competition (Competition). Entrants can enter a Competition to be in with a chance of winning a prize (Prize).

2. Competitions

2.1 By submitting a Competition entry, entrants (each an Entrant, collectively Entrants) are agreeing to be bound by these terms and conditions.

2.2 The Promotor may run several Competitions at the same time as displayed on the Website from time to time. Each Competition shall have its own name and the Prize(s) for that Competition will be displayed on the Website.

2.3 The price and availability of tickets to enter into a Competition will be displayed on the Website.

2.4 Each Competition will display the period of promotion to include a start date and end date (Promotion Period) during which time tickets may be purchased.

2.5 Each Competition will show the maximum number of tickets available for that Competition.

3. How to enter

3.1 To enter a competition through the Website, Entrants must first create an online account by providing an email address, name, date of birth, residential address and contact telephone number. Entrants’ information shall be processed in accordance with our privacy policy.

3.2 It is the responsibility of Entrants to keep their account details private, accurate and up to date. The Promoter accepts no responsibility for an Entrant’s failure to keep their account details updated or secure.

3.3 Entrants must contact the Promoter immediately if they believe, suspect or know that a third party has used their account and/or given any instruction in relation to it without permission, or if they believe, suspect or know their password has been compromised.

3.4 There is no charge payable for creating an account.

3.5 Once an Entrant has created an online account, they may then enter a Competition online by following the steps for that Competition, playing the skill-based game and paying for their required number of tickets. Each ticket is a separate entry into the Competition draw which will be allocated a number by the Promotor.

3.6 Entrants may also enter a Competition for free by post. Purchasing tickets to enter a Competition does not increase an Entrant’s chances of winning a Prize.

3.7 Entrants who have created an account can also enter a Competition by post by completing the following steps:

(a) Entrants must send their entry by first class or second class post to the Promotor at LUCKY AURA COMPETITIONS, Riverside Business Park, 3 Connaught House, Benarth Road, Conwy, LL32 8UB.

(b) Entrants must include the following information on their postal entry:

(i) Full name

(ii) Address

(iii) A telephone number and email address where the Entrant can be contacted

(iv) Name of the Competition which the Entrant is entering

(v) The answer to the question as displayed on the Competition.

3.8 All information supplied must exactly match the information displayed in the Entrant’s account.

3.9 Entrants may make multiple postal entries for a Competition (subject to any limit stated in the description of the Competition) provided that each postal entry is submitted and posted to the Promoter separately. Multiple and bulk entries posted together will not be accepted and this shall be classed as one entry. One postal entry means one ticket into the Competition draw.

3.10 Once a free entry by post has arrived and has been validated and processed, the Entrant will be allocated a ticket at random from those still available and this will appear in the Entrant’s online account.

3.11 Invalid, incomplete or illegible postal entries, or entries received after the closing date or once all tickets have been taken will not be entered into the Draw.

3.12 Postal entries must be received on or before the stated closing date for the  Competition. Entrants must allow plenty of time for their postal entry to arrive.

3.13 Postal entries should be made by first or second class post, the Promoter cannot accept “signed for” deliveries.

3.14 Entrant must ensure that their postal entry details contain all of the required information otherwise the Promotor will be unable to attribute the postal entry to the Entrant’s account and that entry will not be valid nor entered into the Draw.

3.15 The Promotor cannot acknowledge receipt of postal entries or confirm if an Entrant’s answer to any Competition question has been answered correctly.

3.16 The Promoter will not accept competition entries that are:

(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) incomplete.

3.17 If Entrants are asked a question to enter a Competition, only correct answers will be included in the draw. Payment for paid entries is still taken for incorrect answers and no refunds will be given.

3.18 An Entrant will be deemed as having entered the Competition once their draw number(s) is displayed in their online account.

3.19 The Promotor’s database clock will be the official timekeeper for each Competition. Entrants should not enter a Competition after the Promotion Period has ended as this will result in that Entry not being counted but the Entrant may still be charged.

3.20 Should an Entrants’ payment fail or be reversed then their entry will automatically be cancelled, and their tickets will not be entered into the final draw. Such entries will become available for other Entrants to purchase.

3.21 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of transmission as proof of receipt of entry to the Competition.

3.22 The Promoter reserves the right to cancel any Competition at any time during the Promotion Period and should this be the case, the Promoter will notify each Entrant via their online account or by email. The Promotor shall then either

(a) refund any payment made to Entrants using the same method as payment was made or

(b) if an Entrant agrees, apply a credit to the user’s account which they can use to enter other Competitions.

3.23 Where a payment has been refunded, or a credit applied to the account under clause 3.22 the Promoter will have no further liability to the Entrant for cancellation of a Competition.

4. Eligibility

4.1 The competition is only open to all residents in the UK aged 18 years or over, except:

(a) employees of the Promoter

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 By entering a Competition, an Entrant confirms that it is doing so lawfully, it is eligible to enter and eligible to claim any Prize it may win. The Promoter may require an Entrant to provide proof that it is eligible to enter any Competition.

4.3 The Promoter reserves all rights to disqualify any Entrant with no refunds given if:

(a) their conduct is contrary to the spirit or intention of the prize competition.

(b) It has reasonable grounds to believe that they are in breach of these terms and conditions.

(c) They are abusive or defamatory to the Promotor or the Promotor’s staff.

(d) They obtain or attempt to obtain more than the maximum stated number of entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial competition subscription notifications and/or entering services.

(e) It has reasonable grounds to suspect any fraudulent activity.

(f) It has reasonable grounds to suspect any activity which could affect the fairness or integrity of the Competition.

5. Instant Wins

5.1 A Competition may have an instant win feature whereby a prize is allocated to a certain draw number (IW Prize). IW Prizes are allocated to draw numbers randomly. The free postal route applies to Instant Win Competitions.

5.2 The IW Prizes and the draw numbers allocated to them shall be displayed on the Competition.

5.3 When an Entrant successfully enters a Competition, if the Entrant is allocated the draw number associated with the IW Prize, that Entrant will win the IW Prize.

5.4 An Entrant will know instantly if they have won an IW Prize as this will be displayed in the ‘My Instant Wins’ area of the Entrant’s account (accessible at ‘My Account’). A separate instant winner email will also be sent to winners of an IW Prize.

6. The Prize

6.1 The Prize for each Competition and any applicable IW Prizes will be displayed on the Website.

6.2 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value. Some Prizes may be supplied by third party suppliers.

6.3 All images of Prizes on the Website are for illustrative purposes only.

6.4 The Prize is not negotiable or transferable.

7. The Draw

7.1 The Draw will take place on the date displayed on the Website or, if there is no date displayed, within 7 days of the closing date (Draw Date)..

7.2 The winner of the Competition (Winner) shall be randomly selected from all qualifying entries by a using a random number generator.

7.3 Unless stated otherwise on the Competition, there will be one winner of the Competition.

7.4 In the event of an error occurring during a Draw, including but not limited to, human error, or an incorrect range of ticket numbers being used, which may affect the Draw process, Company reserves the right to delay, restart, reschedule, and/or redraw the affected Competition(s) to establish a winning ticket number.

8. Winners

8.1 Due to the nature of the Competitions there can only be one Winner per Competition. On occasions, the Promotor may choose to run a Competition which also offers a runner-up prize or prizes and should this be the case, such will be displayed on the relevant Competition page on the Website. For the avoidance of doubt, no Competition shall include runner-up prizes as standard.

8.2 The Promoter will contact the Winner as soon as practicable after the draw has taken place using the telephone number or email address associated with the Winner’s online account.

8.3 The Promotor reserves the right to ask any Winner to show documentary evidence to verify the Winner’s identity, account details and age. If the Winner cannot provide evidence of the same to the Promoter’s satisfaction, then the Winner may be disqualified and the Promotor may at its sole discretion conduct another draw to determine a new Winner.

8.4 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on the Website.

8.5 If an Entrant objects to any or all of their surname, county and winning entry being published or made available, please contact the Promoter at hello@luckyaura.info. In such circumstances, the Promoter must still provide the information and winning entries to the Advertising Standards Authority on request.

8.6 The Promoter will make all reasonable efforts to contact the winner. If the Winner cannot be contacted or is not available, or has not claimed their prize within 7 of days of the date of the draw, the Winner shall be disqualified automatically and the Promoter reserves the right conduct a new draw from the original entries in accordance with clause 7 to randomly select a new Winner.

8.7 The decision of the Promoter is final and no correspondence or discussion will be entered into.

8.8 The Promoter does not accept any responsibility if a Winner is not able to take up the prize.

9. Delivery of Prizes

9.1 We will deliver the Prize to the Winner at the address associated with the Winner’s online account or such other address as notified by a Winner in writing and approved by the Promoter.

9.2 Standard delivery of the Prize shall be free of charge to addresses within the UK.

9.3 The Prize is provided on an “as is” basis and the Promotor provides no guarantee as to the quality, fitness for purpose or suitability of any Prize awarded other than any warranty or guarantee provided by the manufacturer of the Prize.

9.4 The Promotor shall not be responsible for any Prize once it has been delivered the Winner’s address.

9.5 The Promoter may keep hold of the Prize free of charge for up to 30 days from the date of the draw after which time it shall be delivered to the Winner. If the Winner would like the Prize to be stored by the Promoter for more than 30 days then such storage shall be at the Winner’s expense and the reasonable costs of such shall be payable to the Promotor prior to shipment of the Prize.

10. Limitation of liability

10.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Entrants’ statutory rights are not affected.

10.2 The total aggregate liability of the Promoter to a Winner in respect of a Prize shall be limited to the value of that Prize.

10.3 The total aggregate liability of the Promoter to an Entrant who is not a winner of a prize shall in respect of a Competition be limited to the amount paid by the Entrant to enter such Competition.

10.4 The Promotor will not be responsible for losses which are:

(a) Unforeseeable

(b) Caused by an event outside the Promotor’s control

(c) Business losses.

10.5 Nothing in these terms shall exclude an Entrant’s statutory rights.

10.6 The Promotor does not accept any responsibility or liability for:

(a) incorrect or inaccurate entry information, or for any faulty or failed electronic data
transmissions;

(b) any unauthorised access to, or theft, destruction or alteration of entries at any point in the operation of a Competition;

(c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilised in any aspect of the operation of a Competition;

(d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof;

(e) suspended or discontinued Internet, wireless or landline phone service; or

(f) any injury or damage to Entrants or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in a Competition or download of any Competition materials.

11. Events Outside the Promotor’s Control

11.1 The Promotor shall not be responsible for events outside its control which may include without limitation, infection by computer virus, tampering, unauthorised intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of a Competition.

11.2 The Promotor reserves the right at its sole discretion to suspend or terminate a Competition in whole or in part, in the event of an event outside it’s control. Should this be the case the Promotor shall immediately suspend all Competitions and draws until such time as the event outside its control no
longer affects a Competition.

11.3 The Promotor reserves the right to award any remaining Prizes in accordance with clause 7 above or to offer a refund of the tickets to each Entrant of the affect Competition.

12. Data protection and publicity

12.1 The Promoter will only process Entrants’ personal information as set out in the privacy policy. See also 8.4 and 8.5, with regard to the announcement of winners.

13. General

13.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any Entrant or user of the Website from participating in a Competition.

13.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes absolutely necessary to do so.

13.3 These terms and conditions are governed by English law. If any Entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.

13.4 The Competitions on the Website are in no way sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram, Google, TikTok, Byte Dance or any other third party. Only the Promotor is responsible for the administration or promotion of the Competitions.
